1. Agreement to these terms

By accessing or using the website at silvermaxcapitals.com ("Site") or any content, materials, or communications we provide in connection with Silvermax Capitals ("we", "us", "our"), you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Site or our services.

2. SEBI registration and regulatory status

Silvermax Capitals is not SEBI-registered as an investment adviser or research analyst at this time. SEBI registration is in process. Until we publish a valid SEBI registration number and details on the Site in a clear, conspicuous manner, you must not treat us, our content, or our communications as issued by a SEBI-registered entity.

Nothing on the Site constitutes a representation or warranty that we hold any license, registration, or approval from the Securities and Exchange Board of India ("SEBI"), stock exchanges, depositories, or any other regulator, except as we explicitly state in writing at the time you rely on it.

You are responsible for verifying our regulatory status independently (including via SEBI and other official sources) before relying on any information or service. If our status changes, we will endeavour to update the Site; you should not assume continuity of registration without checking current disclosures.

3. Nature of information and services

5. No responsibility and limitation of liability

To the fullest extent permitted by applicable law, we and our directors, officers, employees, contractors, and affiliates ("Silvermax Parties") disclaim responsibility and liability for any loss, damage, or harm arising out of or related to your use of the Site, reliance on any content, delay or failure of the Site, errors or omissions in content, trading or investment decisions you make, or third-party products, platforms, or services.

Without limiting the foregoing, the Silvermax Parties are not liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or lost profits, lost data, or business interruption, whether based in contract, tort (including negligence), statute, or other theory, even if advised of the possibility of such damages.

Where liability cannot be excluded but may be limited under law, our total aggregate liability arising from or relating to these Terms or the Site shall not exceed the greater of (a) the amount you paid us specifically for the service giving rise to the claim in the twelve (12) months before the claim, or (b) Indian Rupees five thousand (INR 5,000), except where mandatory law requires otherwise.

You agree that any claim you may have must be brought in your individual capacity and not as a plaintiff or class member in any class or representative proceeding, to the extent such waiver is permitted by law.

6. Indemnity

You agree to indemnify, defend, and hold harmless the Silvermax Parties from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Site, violation of these Terms, violation of applicable law, or infringement of third-party rights.

7. Eligibility and conduct

You represent that you are at least eighteen (18) years old and legally able to enter into these Terms. You agree not to misuse the Site (including scraping, hacking, transmitting malware, or interfering with security or performance) or use it for unlawful purposes.

8. Subscriptions, fees, and separate agreements

If you purchase or subscribe to any paid offering, additional terms (including refund and cancellation rules) may apply and will be presented at the time of purchase or in a separate agreement. In case of conflict, those specific terms govern that transaction to the extent of the conflict.
